It seems there is again a stolen picture to be voted as model of the month in
the Theme Gallery on www.lego.com.

http://www.LEGO.com/gallery/theme/vote.asp

Original builder of the number one model named as "Testarossa" has been
Jonathan Stephenson, although he built it as a Corvette.

I can't reach his homepage under the (old?) URL:
http://www.public.asu.edu/~pebbea/

Has anybody contact to Jonathan?

Regards,

Ben

From their rules:

Pirated images (someone else's photo taken without permission) is cheating if
submitted to the Web Club Gallery as your own. These types of behaviors will
result in denying prospective or continued membership in the Club without our
prior notice.

I don't know how to notify them, but they evidently do care.

Actually, it looks like there are 4 stolen... Unless Scott Schuricht is
5 years old and from Vietnam, and put a (c) 1995 in his picture's upper
left corner :( guess he built it in the womb????

if someone has his e-mail they might want to contact him if he doesn't

this is sad :(

I'm sorry but this is actually getting quite humorous.  How long do you think
the LEGO folks actually look at the pictures before they get put up for voting?
I mean really this one takes the cake.

Obviously the folks at LEGO really don't care too much about this little
contest no matter what they put in their disclaimer.

this is sad :(

Yes it is but you have to just laugh at LEGO's ineptness it really is funny
(Although I am sure those who had their models stolen probably don't think so).

I think the LEGO company needs to hold themeselves to the same high standards
that they hold us to with their fair play agreement.

This provides a pretty clear case that they didn't even apply "due
dillegence" to avoid copyright infringement.  I think they should have to
send $10 LSAH coupons to anyone whose copyrights are violated by their
contest.

Can an assembly of LEGO bricks (ie a model) be copyrighted?  Or is it the
photo of the model that can be copyrighted?

Exactly.
You cannot (as far as I know) copyright an assembly of Lego, but a photograph
that you took can be considered yours by law.

example:
Ansel Addams took many photographs of nature/landscapes in the black and white
poster format.  Those Images are copyright to him, and cannot be used without
permission.
However, he does not own copyright to the landscape itself.
If you went to the same places he did, and took a photo from the same spot,
you could produce a black and white poster version of it and not be breaking
copyright laws.

anyways, thats the way it has been described to me by my professors.  I (and
they) could be wrong, if anyone has different info, I'd be most interested...
since images and copyrights are important to my future career.

cheers!

<snip>

IMHO, either way it is terrible that a parent will totally ignore recommended
ages and let a newborn play with Lego System elements.:-)

Maybe we are blowing this way out of proportion. Perhaps YinYinYin is short for
Scott and Scott lives on another planet with a larger orbit.:-) The biggest
problem is the lack of accountability in creating memberships, you do not even
need to supply an e-mail address!?! So you want to win, you submit an entry
with a membership with a lower age and you lie about the rest of your vitals,
and supply a 'hotmail' type of email in case you win, then give them your real
name and address when claim your prize. Only after you use your 100+ other
false memberships to help vote yourself the winner.

At least the system is fool proof!

Sounds like a good idea.  I would also highly recommend posting publicly
about this to the lugnet.lego.direct newsgroup

   http://www.lugnet.com/lego/direct/

which was set up specifically as a direct communications-to-LEGO channel and
is read regularly by people at LEGO.

As BradJ clarified yesterday,

   http://www.lugnet.com/lego/direct/?n=463

LEGO Direct is TLC's "consumer-facing entity" and is responsible for the
"creation and management of all LEGO Company Internet initiatives."  Thus,
if LD doesn't yet directly manage the LEGO Theme Gallery, it presumably will
at some point, or at the very least presumably has some way to impact and fix
problems such as this.

BTW, since this is largely an issue of legalities, etc., if you do choose to
post a message to the lugnet.lego.direct group, I would recommend including
the text "Attn: LEGO Legal" somewhere in the Subject.  TLC now has at least
one in-house attorney hired specificially to handle Internet-related issues.

Also note that in second place in the builders gallery is the Indy Storm.  Are
the people who run this contest so STUPID that they can't spot a one year old

They should hire Lugnetters.

Anyway, mailing them won't do much good without the urls those were stolen
from:

Pic #1 (Testarossa) is from Jonathan Stephenson, while his old page is down
(possibly taken down in disgust) his stuff is archived at
http://www.execulink.com/~apotome/archives/m0003.htm

Greg Majewski: what is the direct link to your Tango V?

Anyone know of Scott Schuricht's page? There's a link on
http://www.mdn.com/crites/LEGO/pages.html
but it no longer connects to his Lego page.

I known I've seen that futuristic van somwhere but anyone have the url?

Greg,

Just to help you prove the model is yours you may want to upload some other
pictures of different angles of the model.  That way there can be no doubt that
it is yours (I personally believe you but TLC may want more proof than a
picture that looks about identical to the one they have).

Just a thought and BTW the model didn't "suck".  I think we all improve over
time.  That doesn't mean that our older stuff is inferior though.

If you improve, then by default whatever you've improved on is inferior.
"Improvement" implies superiority.

Which, of course, doesn't mean that something "sucks", it just means it's
inferior.  If I say I think "The Empire Strikes Back" is an improvement on
"Star Wars", then I am implying that I think "Star Wars" is inferior to
"Empire".  That doesn't mean I wouldn't rather watch "Star Wars" than a heck of
a lot else.

I don't think Greg's model "sucks", either, but to say he's improved means that
things he's built before are (probably[1]) inferior to things he's building
now.  Which is.... just fine.  I built a castle when I was a kid that would
pretty clearly be inferior to just about any castle I built today- but I still
think the old one had some neat points to it[2].

[1] Anyone can have an off day, or have built a wicked cool model early in
their building career.

[2] Like the catwalk that went over the courtyard for no good reason, other
than for people to duel on.

Damn, I knew inferior was the wrong word as soon as I posted it.  I was just
hopeing no one would call me on it ;-).

I bow to your "superior" wisdom.

Well I always give ANH the nod over ESB but that is a story for another day.
ESB is damn close though and both ROTJ and TPM are definitely inferior to both
ANH and ESB.

But I digress

This is all true I always remember a recuring model, or version there of, that
I would build growing up.  It was a hugh read vehicle that was occupied by no
fewer than 10 classic space men.  It had a control center, cockpit, bunks,
galley, and even a movie theatre in at least one of the versions.  It also had
a trailer that was often 2 levels and housed smaller recon vehicles and more
quarters and a few more classic space men.

The thing was huge and at least at the time I thought it was increadibly cool.
I still think some of the interior details were better than most of what I do
now.  Mostly because I havn't put a lot of focus on interior details lately.

So yah we agree although I didn't word it correctly the first time around.

I like the idea of sending images via the internet.  I like seeing other
people's MOCs, and if they required a photo to be sent in snail mail,
I bet they wouldn't get so many contestants.

It is probably impossible to verify that an image is not stolen.  Take
the black Mad Max Interceptor which was on the fourth place in the theme
gallery, for example.  The original images can be found at

Apart from that, I don't think the author has a personal web page with
his creations on.  Now, how would someone from the web club know that
they needed to check the above location?

BTW, does this mean that there is a total of five stolen images out of
eight in total?

And on a side note, I don't think the author of the black Mad Max
Interceptor has a web page with the model on.  In stead he mailed me all
the images!  Completely unsolicited.  He has also mailed me images of a
new, even larger Audi A6 model he made.  I've told him he would be
better off uploading them to a web page, but I haven't seen them yet.

Right. We also need more than several of us to mail them at
webclub@lego.com and tell them to abolish the process of sending
images via the internet.

He does - I remember visiting it WAY back when he posted about it and loving
it.  I have no idea what the URL is, though.

You're sure it wasn't simply the web page at www.madmaxmovies.com?

Speaking of Stolen creations, What is this JJ SIERRA.COM doing with my Open
top hummer. I have working on a successful Hummer for 3 years and I don't take
stealing lightly.

Compare for yourself

My 4 door soft top Hummer        SECOND one down. color blue

JJ Sierra Hummer

Yes I know there are few mods. but I still see my Hummer in it.

A rule I've made for my LEGO page.
Do not put any form of pictures of any other persons concepts that I have
recreated, unless I have permission or at least a link next to the image.

Example
I have recreated Bram Lambrecht Land Rover and it is noted on the Res-Q 901
page, but not pictured.

Man, that is bad. I wish there was something that could be done to keep models
from being copied.

I don't think it has been mentioned already (I took some time to read
through the thread), but the model currently at fourth place is also
stolen.  It's the Mad Max interceptor model.  The original can be seen
here:

(Sorry if this was already mentioned.)
