Last month at least 5 out of 8 pictures in the Theme Gallery have been
stolen from known AFOLs. That has been discussed in Lugnet and can be found
here:
http://news.lugnet.com/general/?n=20505
I wrote 2 mails to TLC and got an answer, that they would react on it. But now
the builder of the month is announced and you can see: nothing happened at all!
A pirated picture has been voted and announced as winner for the Theme Gallery.

I'm really disappointed again about TLCs behaviour on this. They don't want us
to pirate their pictures and most AFOLs do respect that, but vice versa?
What's your opinion on this?

Keep in mind that I Am Not A Lawyer :-)
In my opinion, since TLC was informed (and acknowledged such information)
about the nature of the photographs the AFOL's in question have a legitimate
reason for charging TLC with copyright violation. Until the end of the
voting TLC could have claimed that they were "still working on it." With
the voting over they cannot make that claim, as SOMEBODY had to setup the
new pages.
It would be interesting to find out if the AFOL's in question contacted TLC
about this. If I recall correctly TLC doesn't have to act on third-party
info...it's up to the offended party to initiate action. Even so, the
honorable thing to do would have been to act on Ben's information ASAP. To
do otherwise is a poor reflection on TLC, but that seems to be a common
occurrence these days...

At this point my opinion is that we should look for a lawyer or law firm
who would be willing to take this on. TLC has repeatedly demonstrated
that they expect IMMEDIATE response from our community when their IP
rights are violated here on Lugnet. I think it is time we demand the
reverse. If they are unwilling to show the same concern they demand of
us, they deserve to be burned at the stake.
I suspect a pretty strong case could be built against them as they are
demonstrating repeated indifference to researching the origins of IP
presented to them for publication. I know that large companies can take
this issue seriously.

When I look at it now the images are all broken links - are they actively
doing something about it now?

I don't think so. Presently there should be new pictures but as long as I know
the galleries, Lego was never able to update them without broken links for the
first two days... Not very professional, if you ask me. Funny is some of the
non existing pictures getting so many votings right now. Maybe the sender of
some pictures read their names and vote themself by use of phantoms?
Regards,
Ben
BTW:
This is the quite fuzzy picture of temporary number 1:

Will you find out, how to get the other ones?

That's funny!
Now TLC has removed the wrongnamed stolen Testarossa (which was a Mustang in
fact) and has exchanged the model of the month against the next stolen picture:
http://www.lego.com/gallery/theme/
The model with name "top fueler" has been created by Alex as "Mad Max" car
and can be found here:
http://www.madmaxmovies.com/fanstuff/lego.html
Since there have been 5 pirated pictures TLC has 3 further trials which might
get wrong....
Loud laughing if it wasn't that stupid...

Jumping in late here, but I think it stinks.
Did anyone manage to snap screenshots of the stolen images being displayed
at their site before they wiped them out at the end of the month and started
fresh with this month's stuff?
IMHO, it would good if we as a community had hard documentation of this in
case the matter worsens...Or perhaps to print on hardcopy and send to LEGO
attorneys to make them aware of the issues.

Well, it is possible that they have set up a script that will automaticaly
create that page, since there is no text that must be written or anything.

Sorry no screenshots of the gallery with 5 pirated pictures, but 2 screenshots
of the Theme Galleries winner of August taken today. It's quite funny they are
both available at the same time. Check this out and read the info.txt.

Kind Regards,
Ben
P.s.: Is there a problem in showing screenshots of www.lego.com? Is that piracy
too?
