Is it "fair" for someone who
hasn't been bidding on an item
to up the bid three hours before
the item is to be marked Sold?

Of course it's fair. If it's within the rules of the auction to do so, then it's fair. This is not to say that it's nice.

If you have a sophisticated auctionbot, you might be able to design in higher minimum bid increments for items marked Going Twice and for other stages.
